Mediation:  Any process for resolving disputes in which a neutral person helps the parties negotiate a settlement or agreement.  It is normally a voluntary and confidential process.  The degree of in-session attorney participation is determined on a case-by-case basis.

Arbitration & Private Judging:  When you and the other party are unable to work cooperatively to resolve your disputes, you may present your case to an Arbitrator or Private Judge.  Arbitration can be non-binding (meaning the decision is not final and the case can still be submitted to the Courts for final resolution); or binding.  When a case is submitted to binding arbitration or a private judge the decisions are made for you on the basis of the evidence and arguments presented, and the decision is final.  Your attorney represents you at the arbitration or private hearing like they would in Court. 

Special Master:  Usually appointed by the Court (sometimes at the request of the parties) to assist disputing parties in resolving conflict outside of and/or as an extension of the Court.
